Flex Credit Terms

1. What Flex credit is

Emotely Flex is a closed-loop credit that may be funded as a gift, issued promotionally, or provided as an adjustment. It may be used only toward eligible gift cards, keepsakes, or other offerings displayed by Emotely in the supported redemption experience.

An organizer may allocate some or all of a Group Emote collection to Flex for the recipient. That allocation becomes final when the group gift is finalized or fulfilled and is subject to the Group Emote provisions in the Terms of Service and Refund Policy. Contributors do not acquire an individual interest in the recipient’s resulting Flex balance.

Flex credit is not cash, legal tender, a bank or deposit account, a general-purpose payment instrument, or a gift card accepted outside Emotely. It does not earn interest and is not protected by deposit insurance.

2. Eligibility and claiming

You must be at least 18 years old, or the age of majority where you live, and have or create an eligible Emotely account to claim or redeem Flex credit.

The recipient is responsible for claiming credit through the intended delivery experience and protecting the delivery link and account credentials. We may require identity, email, transaction, or eligibility verification before making credit available.

Once claimed, Flex credit is associated with the recipient’s account and cannot be reclaimed by the sender, Group Emote organizer, or contributors except where required by law or where Emotely determines that issuance failed or involved fraud or error.

3. Currency

Flex credit is issued in the recipient currency selected by the sender and remains denominated in that currency after purchase and claim. A sender may pay in a different supported checkout currency using the exchange-rate quote disclosed at checkout.

Flex balances in different currencies are separate and are not automatically converted or combined. Redemption must occur through offerings eligible for the balance’s currency and region.

4. Redemption and availability

Available merchants, products, denominations, regions, and redemption requirements may change. Displaying an offering does not guarantee availability until redemption is completed.

If the selected offering costs more than the available Flex balance, an additional payment method may be required where supported. Any unused balance remains in the account unless otherwise disclosed. Flex credit cannot be used to buy additional Flex credit unless Emotely expressly permits it.

Third-party gift cards and products obtained through redemption are governed by their issuer, merchant, fulfillment, and product terms.

5. No cash redemption or transfer

Flex credit is not redeemable for cash, refundable for cash, or exchangeable for another currency except where required by law or expressly allowed in writing by Emotely.

Flex credit may not be sold, assigned, transferred between accounts, pledged, or used for commercial resale unless an Emotely feature expressly permits the action.

6. Expiration

Purchased Flex credit does not expire unless an expiration is clearly disclosed before purchase and permitted by law. Promotional or complimentary Flex credit may expire under terms disclosed when issued.

We may treat an account as abandoned and remit value to a government authority where unclaimed-property law requires it.

7. Refunds, errors, and reversals

Flex purchases and balances are subject to our Refund Policy. Once credit has been claimed or used, a purchase is generally final except where required by law.

We may correct balance, currency, issuance, or redemption errors and reverse duplicate, mistaken, unauthorized, refunded, charged-back, or fraudulently obtained credit. We will not remove legitimately purchased credit without a lawful basis.

8. Fraud and misuse

We may delay a claim or redemption, restrict an account, request verification, or suspend associated credit while investigating suspected fraud, unauthorized access, sanctions concerns, promotion abuse, resale, or violation of these terms.

Credit obtained or used through fraud, chargeback abuse, or material violation may be revoked without compensation, subject to applicable law.

9. Program changes

We may change eligible offerings, providers, interfaces, and prospective program rules. We will not retroactively reduce the face value of legitimately purchased Flex credit, and any suspension or discontinuation will be handled subject to applicable law.

10. Liability and governing terms

The disclaimers, liability limitations, governing-law provisions, and other general terms in the Emotely Terms of Service apply to Flex credit. Mandatory rights under applicable consumer and stored-value laws are not excluded.
